These Terms of Service ("Terms") govern your use of the Gather mobile application and website (collectively, the "Service") operated by Gather ("we", "our", or "us"). By creating an account or using the Service, you agree to these Terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Gather app on devices you own or control, solely for your personal, non-commercial use. This license does not include any right to sublicense, modify, copy, adapt, or distribute the app. All rights not expressly granted are reserved by Gather. This license is in addition to any rights provided by Apple under the App Store Terms of Service.
You must be at least 13 years old to use Gather. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
You may sign in using a phone number verified by SMS. You are responsible for all activity that occurs under your account. Keep your credentials secure and notify us immediately at support@gather-any.day if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
Gather offers an optional auto-renewing subscription ("Gather+") that unlocks unlimited gatherings and AI planning features. Your first gathering is free without a subscription.
Subscriptions are processed and managed by Apple. We do not have access to your payment details. Your purchase is also subject to Apple's payment terms.
You agree not to:
By signing up for a Gather account with your phone number, you consent to receive SMS messages from Gather for the purposes described below. Gather does not use SMS for marketing or promotional content.
Recipients invited by another Gather user: If another Gather user invites your phone number to a gathering and you do not yet have a Gather account, you will first receive a single one-time verification text identifying the sender and asking you to reply YES to receive details or STOP to decline. You will not receive any further messages from Gather unless and until you reply YES. A YES reply opts you in to receive the message types listed below for gatherings you are invited to; a STOP reply (or no reply) means you will not receive further messages.
Types of messages (once opted in):
Message frequency: Message frequency varies and depends on activity on gatherings you are involved with. Recipients who have not opted in via YES receive only the single verification text and nothing further.
Carrier charges: Message and data rates may apply. Gather does not charge for SMS, but your carrier may.
Opt out: Reply STOP to any Gather SMS to opt out of all non-verification SMS from Gather. To resume messages, reply START. Reply HELP at any time for help, or contact support@gather-any.day. Note: opting out does not affect SMS verification codes, which are sent only when you request them by attempting to sign in.
Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.
Consent and contact lists: If you use Gather to invite a phone-number contact who is not on Gather, you represent that the contact has a pre-existing personal relationship with you. The recipient must affirmatively reply YES to the verification text before Gather will send them any further messages, and may reply STOP at any time to be removed. Gather will not use a recipient's phone number for any purpose beyond the gathering they were invited to and the related notifications described above.
Account removal: You can remove your phone number from your account by deleting your account in the app, though doing so will affect your ability to sign back in. Recipients of contact-based invitations who do not have a Gather account can opt out by replying STOP and will be removed from any further message flows.
Connecting Google Calendar is optional. If you do, Gather requests read-only access to your free/busy data solely to suggest meeting times. We do not read, store, or share event titles, descriptions, or attendees. You may disconnect your calendar at any time from the Account screen in the app, or through your Google Account permissions.
Gather uses Claude (by Anthropic) to generate gathering suggestions. These suggestions are provided for convenience and may not always be accurate, appropriate, or available. You are responsible for verifying any suggested times, venues, or activities before acting on them. We are not liable for decisions made based on AI-generated suggestions.
You retain ownership of any content you submit (gathering names, messages, etc.). By submitting content, you grant us a limited license to store and display it as necessary to operate the Service. We do not claim ownership of your content and will not use it for advertising.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms.
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We are not responsible for the actions of other users or for gatherings that do not occur as planned.
To the maximum extent permitted by law, Gather shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the twelve months preceding the claim (or $10 if you have not paid us anything).
You may stop using the Service at any time and request deletion of your account by contacting support@gather-any.day. We may suspend or terminate your access if you violate these Terms, with or without notice.
We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in California.
